About AMG’s Apple Loops Producer Series Commercial Licences - FAQs

Q: Why do AMG have titles with different rights included in their purchase price?
A: AMG want to offer our Apple Loop customers the widest possible range of the best samples from our huge catalogue. The vast majority of our catalogue is designed for professional users and includes the right to use the featured samples in commercial recordings as standard. Most GarageBand users probably don’t require this licence as they only use the products for their personal enjoyment rather than commercial exploitation. It therefore seems unfair to make them pay for something they do not require. Therefore we decided to split the rights so we can offer non-commercial users the best possible samples without them having to pay for rights they don’t require. It also gives commercial users the opportunity to try the samples first and only pay the additional commercial licence fee when they actually decide to use the samples commercially which is another benefit. We hope people will see the benefits of this system but appreciate it might be a little mind-boggling for some people. Please feel free to contact us with any suggestions you may have to make the process as simple and understandable as possible. We have tried to achieve this but realise there might be room for improvement.

Q: Do I need to purchase a commercial licence?
A: You only need to purchase a licence and become a registered AMG licensee if you’re going to release commercial recording, or submit a recording for academic assessment, that feature samples from the AMG products that expressly require this. Although we still expect non-commercial users to adhere to the general licence requirements of the product in question of course. Of course the purchase of a commercial licence will be required if the purchaser later decides they wish to use samples from AMG on their commercial recordings.

Q: What benefits are there to being a licensee?
A: The clarity that a clear licence agreement offers will benefit our licensees in their liaisons with record companies. We get many requests about sample usage instigated by concerned record companies - many of these unnecessary hassles for all concerned will thus be avoided. By having a strong licensing policy you know that AMG will be able to protect your investment in our CDs. Whilst you will be free to enjoy using them commercially any party using pirate copies knowingly or otherwise will be in grave danger of landing themselves, or those they work with, with serious copyright problems. Additionally AMG will consider replacing any stolen or lost registered products for an administration fee well below cost, acting as a secondary form of insurance for your investment.

Q: What do I need to do to become an AMG licensee?
A: Every AMG product that requires a signed licence for commercial use will be clearly marked as such externally. The purchaser can then decide to purchase the additional commercial licence for that title if necessary.

Q: What do I need to do when I release a commercial recording using AMG’s samples?
A: You will need to comply with whatever terms are set out in the licence agreement for the products you are using. These will be clearly stated on the applicable licence agreement you have purchased and can be referred back to if you have any doubts. Generally these requirements are kept to a minimum. If any term troubles you please contact AMG. We will try to overcome any issues you have, we want to make the licensing process as simple and easy to comply with as possible.

Q: What do I need to do when I buy more CDs in the future?
A: Just buy additional commercial licences for any that require one that you intend to use commercially. There are a wide range of AMG titles available at a range of prices and in various styles. Many come with commercial usage included as standard as part of the purchase price too. You can choose which suit you and your needs best from the selection available.

Q: Is there anything else I should know?
A: It may become necessary to make slight alterations to licence agreements from time to time or from product to product. The current licence terms are available at www.samples4.com in the appropriate listing for the title covered. No fundamental changes will be made without your express acceptance and only apply to subsequent usage if agreed. All licensees for whom we have e-mail addresses will be kept abreast of developments and alterations in this area. AMG Apple Loops Producer Series COMMERCIAL LICENCE TERMS

Purchasers of AMG Apple Loops Producer Series CD’s who wish to make commercial use of the CD (i.e. include any part of it in any recording made available to the public rather than exclusively for their own private use) or to use it for any form of academic purpose whatsoever must obtain a licence prior to any such use on the following terms from AMG. If you do not obtain a licence any commercial or academic use of the CD will infringe AMG copyright and AMG may be entitled to damages for this infringement and/or to stop the sale or distribution of your recordings. All material on AMG CDs has been specifically recorded by artists chosen by AMG and the artists have consented to such material being licensed by AMG under this Licence. AMG accepts no liability for any direct, indirect, or consequential loss arising from the use by Licensees of AMG’s Products.

This Licence will be granted by AMG once you, the purchaser (also called the Licensee) of the AMG Apple Loops Producer Series Product has purchased the appropriate licence on-line at www.samples4.com for the title purchased that you now wish to now authorise for commercial use. You have to buy a licence for each CD you wish to upgrade for commercial useage. AMG reserves the right to withhold a Licence at their discretion and refund any licence fee paid in any such instance.

Therefore, in summary, to obtain a licence for AMG Products you must: A) Be the original purchaser of the appropriate Apple Loops Producer Series title you wish to licence. Retain the physical product, ideally also proof of purchase (history of purchases from www.samples4.com will be archived in your account automatically) and adhere to the following licence terms. B) Open an account at www.samples4.com and purchase commercial licences for the title(s) you own and wish to licence for commercial use.

1. LICENSEE DETAILS
I, the Licensee, hereby apply for an AMG Apple Loops Producer Series single user Licence for 'the licensee'. My details as supplied to complete the purchase of this licence are those of the licensee and by purchasing the licence I am agreeing to it’s terms.

2. GRANT OF LICENCE
2.1 AMG grants a single user licence (SUL) to the individual purchaser of 'the CD' that they have also purchased.
2.2 This licence allows the Licensee to use any part of the Product in a recording made or produced by the Licensee which is then made commercially available to the public provided the Licensee complies with the Licence conditions listed below. The licence will last unless and until revoked by notice from AMG to the Licensee and a refund of the licence fee made in this instance. Providing the licence terms are adhered to no addition fees will be required once this licence is purchased.

3. LICENCE CONDITIONS
3.1 The Licensee must credit the use of the AMG Product on every commercial recording released which incorporates any part of the product where this is physically possible and reasonable to expect. Credit should be given in the form “Some samples used under licence from AMG”. Every such use must be reported to AMG prior to release and, ideally, a copy of the finished product must be submitted to AMG within 12 months of its release.
3.2 The Licensee must make every effort to ensure that the Licensed Product and any samples taken from it remain in his or her possession or control.
3.3 This licence is personal to the named Licensee and cannot be sold or transferred to any other person. Excerpts from a Licensed Product may only be used on commercial recordings where the Licensee is named/credited as the recording artist, producer or programmer. If the Licensee is not credited in one of these roles, one of the named parties will have to apply for his or her own licence prior to any commercial use occurring.
3.4 This Licence does not allow the product to be used in library music or any similar commercial project that is carried out with the intention of producing a product whose contents are then sub-licensed to third parties who choose to utilise it on any basis whatsoever. No part of the Product, or any derivative of it, can be included on any competing product in its original or any modified form whatsoever without prior written permission from AMG.
3.5 The Licensee may not distribute any part of a product for use by a third party except for the express purpose of incorporating it into a licensed recording. The Licensee is not permitted to produce a compressed version of the Licenced Product in any format (such as MP3) unless it is for the express purpose of co-writing compositions and in such instances only an insubstantial portion of the licensed product that is actually being used may be compressed.
3.6 The Licensee grants permission to AMG to send information regarding AMG products and services to the Licensee and to hold the Licensee’s details on computer. The Licensee agrees to keep their account details at www.samples4.com up to date to ensure communication is possible.

By purchasing this licence you are accepting the terms of the above Licence which comes into effect upon the successful completion of the associated payment required.
